Action Plan

We have been in discussion with the owner’s planning agent and the way forward is proposed as being : 

  1. That the owner is invited to make a planning application setting out why the hardstanding and bund are required in connection with the lawful use of the land.

This will enable the development along with a landscaping scheme to be formally considered.  Such may then assist in overcoming the harm from the works.

  1. To submit a certificate of lawfulness in respect of any of the works that it considered to be immune to enforcement action.
  2. To submit a lawful development certification in respect of any works that are considered to not require permission so this can be legally determined.

Update – 08.12.25

I am in discussion with them about the removal of the newest part of the bund.

If they remove the new part of the earth bund that was most recently created, there will be no need to make a planning application to retain it.

The outstanding matters that will follow will then be: 

  1. How to resolve the existence of the bund they claim has been in situ for many years
  2. The hardstanding over the paddock

Regards the fencing, yes we are aware of it and have already investigated it, reaching the conclusion that it was not expedient to pursue further action.
